Privacy Policy
PingPod Inc. (“PingPod”, “we” or “us”) recognizes the need to protect the privacy of the personal information you provide to us with respect to your access and use of PingPod’s website (https://pingpod.com) (the “Website”) or through PingPod’s mobile and web applications (http://app.pingpod.com) (the Website and such mobile and web applications being collectively referred to as the “Applications”).
We have adopted this privacy policy (the “Privacy Policy”), which sets forth, among other things, the type of information that will be collected, the purpose and use of the collected information, and your rights with regard to the collected information.
This Privacy Policy governs how we collect and use your personal information wherever you use our Applications. If you do not agree with our policies and practices, your choice is not to use our Applications. By accessing or using the Applications, you agree to this privacy policy.
This policy may change from time to time. Material changes to this Privacy Policy will be effective: (i) thirty (30) days after PingPod provides notice of the material changes, whether such notice is provided through the Applications user interface, is sent to the email address associated with your account, or otherwise; or (ii) when you opt-in or otherwise expressly agree to the material changes or a version of this Privacy Policy incorporating the changes, whichever comes first. Your continued use of the Applications after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
1. Protection of Your Information
We are accountable for the information in our custody. Therefore, when we collect or use your information, we will utilize commercially reasonable safeguards to ensure its protection.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Applications, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Applications like message boards. The information you share in public areas may be viewed by any user of the Applications.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Applications. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Applications.
2. Type of Information Collected and Use
We collect two types of information through our Applications:
Non-Personal Information. Upon accessing the Applications, certain non-personal information will be automatically collected without your knowledge or consent, such as your IP address, location data, and the referring website (“Non-Personal Information”). We use Non-Personal Information to examine our traffic and to view how our customers use the Applications. This type of information will not allow you to be personally identified, although we might be able to associate it with your account. For example, we use “cookies”, which contain only certain statistical information. For more information on cookies please see Section 9 below.
Identifying Personal Information. To utilize some portions of the Applications or the services we provide, you must provide personal information that will allow you to be identified (Personal Information), including (i) your name, mailing address, phone number and email address; (ii) credit card information and charge history; (iii) unique identifiers such as user name, account number, and password; (iv) preferences information such as product or content interests, and communication or marketing preferences; (v) device information and data; (vi) reservation history and coupon usage history; (vii) Google, Twitter and Facebook identity; and (viii) video and audio recordings of you when you are in our facilities. You may provide information by filling in forms on the Applications, requesting further services, entering a contest or promotion sponsored by us, reporting a problem with the Applications, corresponding with us (including with your email address or phone number), responding to surveys that we might ask you to complete for research purposes, entering transactions through the Applications, conducting search queries on the Applications, and visiting our physical facilities.

Additionally, Personal Information may be used and disclosed to the extent PingPod may deem reasonably necessary to enforce the terms of any agreement between you and PingPod, including billing and collection, or to protect the rights, property or safety of any person or entity.
We will not use your Personal Information for any other purposes without your consent.
3. Request to Examine Information
Should you wish to examine your Personal Information, please send us a written request to [email protected]. In certain cases, we may not be able to provide you with access to all of your Personal Information (e.g., if the information also pertains to the Personal Information of another user).
4. Sharing Information
We will not sell, rent, or disclose to third parties the information we collect and save except that we may share the collected information with other parties as follows:
Marketing, Advertising, and Social Media. We may share Personal Information in the form of recorded video, images, and audio of you and your guests in PingPod marketing, advertising, and social media. We may share Non-Personal Information and aggregated information with third parties, including, but not limited to, for advertising or marketing purposes. When you use the Applications, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties include: advertisers, ad networks, and ad servers; analytics companies; your mobile device manufacturer; and your mobile service provider. These third parties may use tracking technologies to collect information about you when you use the Applications. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see Section 11.
Affiliates and Service Providers. We have agreements with various affiliates and service providers to facilitate the functioning of the Applications and the services we provide, and we may share the personal information we have collected with them. For example, we may share your credit card information with the credit card service provider to process your purchase, and we may share video recordings of you and your guests with third-party service providers who help us improve our service and improve security at PingPod Spaces. All affiliates and service providers are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
Where required by law. We may share the collected information where required by law, specifically in response to a demand from government authorities where such demand meets legal requirements.
Transactions. In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition, or in any other situation where Personal Information may be disclosed or transferred as one of our business assets.
PingPod offices and operations. We may share Personal Information and Non-Personal Information with our affiliate companies in order to provide you with our services and for our own operational processes.
To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “invite a friend” feature of the Applications, we use the email address or SMS messaging to transmit information and your email address to the recipients.
5. External Links
The Application contains links and references to other websites and social media sites, including but not limited to a group on Slack for PingPod users. We are not responsible for the collection, use, and disclosure of information, or the privacy practices of such websites, and we expressly disclaim any liability relating thereto.
6. Payment processing
Payment details you provide will be encrypted using secure sockets layer (SSL) technology before they are submitted over the internet. Payments made on the Applications are made through our payment gateway provider, Stripe. You will be providing credit or debit card information directly to Stripe which operates a secure server to process payment details, encrypting your credit/debit card information and authorizing payment. Information which you supply to Stripe is not within our control and is subject to Stripe’s own privacy policy and terms and conditions.
7. Terms of Service

8. Persons Under 13
The Applications are not marketed toward persons under the age of 13. If PingPod discovers that it has inadvertently collected Personal Information about individuals under the age of 13, it will promptly delete such information.
9. Cookies and similar technologies
When you interact with the Applications, we try to make that experience simple and meaningful. When you use our Applications, our web server sends a cookie to your computer or mobile device (as the case may be). Cookies are small pieces of information which are issued to your computer or mobile device when you visit a website or access or use a mobile application and which store and sometimes track information about your use of a website or application. A number of cookies we use last only for the duration of your web session or Applications session and expire when you close your browser or exit the Applications. Other cookies are used to remember you when you return to the Applications and will last for longer.
Some of the cookies used by the Applications are set by us, and some are set by third parties who are delivering services on our behalf.
Most web and mobile device browsers automatically accept cookies but, if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set. You can also learn more about cookies by visiting www.allaboutcookies.org which includes additional useful information on cookies and how to block cookies using different types of browsers or mobile devices. Please note, however, that by blocking or deleting cookies used on the Applications, you may not be able to take full advantage of the Applications.
The Applications use cookies and similar technologies to cookies to collect information about your access and use of the Applications. You can also update your privacy settings on your device by setting the ‘Limit Ad Tracking’ and Diagnostics and Usage setting property located in the settings screen of your Apple iPhone or iPad, or by resetting your Android ID through apps that are available in the Play Store. You can also stop information collection by uninstalling the Applications on your device and you can use the standard uninstall process available as part of your device for this purpose.
10. Social Media
You can log-on to your account with us by using social media plug-ins from social media platforms such as Twitter and Facebook. If you choose to log in via a social media platform, our Applications will connect to the servers of the social media platform. We will receive your basic profile information as directed by the relevant social media platform when you log in. You will also have the option to share features of our Applications with the relevant social media platform as you wish. 11. Your Choices About Our Collection, Use, and Disclosure of Your Information
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.
Tracking Technologies. As described in Section 9, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent, or to adjust preferences in your mobile device settings. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Applications may then be inaccessible or may not function properly.
Promotion by the Company. If you do not want us to use your contact information to send you messages about our products or services, you can opt-out by using the unsubscribe link in emails you receive or by sending us an email stating your request to [email protected].
Third Party Data Collection. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.
